Senior Legal Counsel – Dispute and Investigations

CIMIC Group Limited is the parent of our various Operating Companies. CIMIC sets the strategic direction, financial expectations, risk profile and governance framework for the CIMIC Group and monitors the performance of its Operating Companies (CPB Contractors, Sedgman, UGL, Pacific Partnerships and EIC Activities).

Overview

This is a key role that will be responsible provide legal expertise and oversight of disputes across the Group. This role requires someone to lead the Group-wide strategy regarding disputes, insurance and regulatory investigations and directly manage disputes involving CIMIC, EIC, Devine and Leighton Properties. The role also acts as Business Conduct Representative for CIMIC, Pacific Partnerships, EIC, Devine and Leighton Properties and is the Privacy Officer of the CIMIC Group.

Key responsibilities for the role include:

Leadership

  • Leading Group-wide disputes functions and disputes reporting to ensure CIMIC strategy is applied consistently across all operating companies.
  • Considering and advising on necessary updates to group’s precedents, policies and procedures as they relate to the management of disputes with ability to draft and improve legal templates, policies and procedures.
  • Project managing aspects of legal projects and initiatives with cross functional stakeholders as directed from time to time.
  • Supporting CIMIC Group General Counsel in advising CIMIC Executive, CIMIC Board and CIMIC’s Shareholders on legal issues affecting the Group.
  • Coordination of Group legal spend and assisting Group General Counsel will management of Panel Law Firm relationships.
  • Monitoring changes in law and communicating monthly to CIMIC.

Disputes and Investigations

  • Providing high quality, strategic and commercially focused legal and regulatory advice to the CIMIC Executive around all material disputes within the Group.
  • Reviewing, analyzing and challenging all disputes resolution strategies and collaborate with OpCo legal teams to ensure best practice is followed.
  • Managing all disputes involving CIMIC companies including instruction of counsel, settling of pleadings, and appearing/advocating directly on behalf of CIMIC.
  • Coordinating quarterly disputes reporting and discussing relevant positions with CIMIC finance teams and CIMIC’s auditors.
  • Responding to regulatory notices and investigations.

Business Conduct Representative and Privacy Officer

  • Acting as CIMIC Business Conduct Representative and Chair of CIMIC Reportable Conduct Group.
  • Managing reporting of all group Ethics matters (eg breaches of Code of Conduct, sexual harassment etc), liaising with OpCo RCGs and preparing quarterly reports to CIMIC Board.
  • Managing the Group’s relationship with Ethics line providers.
  • Providing face to face training on CIMIC’s Code of Conduct and related matters

General Legal

  • Provide advice in relation to breaches of contracts and the enforceability of agreements and the like, including recourse to litigation and remedies.
  • Provide advice in relation to trade practices, fair trading and competition/probity issues affecting tender functions of the CIMIC Group.
  • Provide general commercial legal and reviewing and negotiating a range of contracts.
  • Assist with management of intellectual property, trademark and copyright, including transfer or retention of intellectual property, and claims of infringement.

Education and Qualifications required for this role:

  • A degree in Law from an Australian University or suitable international equivalent.
  • Current legal practicing certificate or eligibility for admission as a legal practitioner in Australia.
  • Substantial post-admission relevant experience

Experience, Skills and Behavioural Competencies required for this role:

  • A minimum of 8 years PQE in disputes within a reputable firm and/or in-house experience.
  • Experience and expertise in construction law and disputes and the applicable legislative and regulatory landscape.
  • General commercial disputes and Australian civil procedure experience.
  • Experience with criminal or regulatory processes favorable.
  • Solid understanding of infrastructure, construction, industrial services and mining markets including in respect of legal landscape, competitors, clients, projects and government stakeholders.
  • Experience reporting to and influencing senior executives and experts with industry-leading experience.
  • Experience overseeing a contract management, claims and disputes at a project level favorable.
  • Exceptional drafting, verbal and written communication skills with the ability to effectively convey an opinion, position or counter-position on a matter in plain English.
  • Exceptional influencing, interpersonal, collaboration and negotiation skills with high emotional intelligence.
  • Strategic mindset able to see the bigger picture and monitor trends across industries and sectors.
  • Innovative – seeking to drive best for Group outcomes through new and better ways.
  • Able to recommend and implement change and manage change process in a collaborative way.
  • Ability to analyse data and identify trends, intelligence to inform legal approach and priorities.
  • Motivated and able work autonomously to deadlines, manage conflicting priorities in a high-volume work environment.
